1. Online Terms and Conditions
This page sets out the terms and conditions on which we supply any of the products (Products) listed in our on-line store (our store) to you. Please read these terms and conditions carefully before ordering. By ordering you agree to be bound by these terms and conditions.
2. Interpretation
The following Conditions shall apply to all contracts concluded by IQ Interiors Ltd, Trading as Sculleries of Stockbridge, the following words shall have the following meanings: The Seller shall mean Sculleries of Stockbridge. The buyer shall mean the person, firm or company entering into the Contract to purchase the Goods from the Seller. Writing includes fax, e-mail, or post. The headings in these Conditions are for convenience only and shall not affect their interpretation.
3. Basis of the Sale
Sculleries of Stockbridge shall sell, and the Buyer shall purchase the Goods in accordance with specified design created on our buying platform. After placing an order, you will receive an e-mail acknowledging that we have received your order. This does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance, we will confirm acceptance by sending you an e-mail that confirms the details of the order. The contract between us (Contract) will only be formed when you accept the terms of our delivery. The Contract will relate only to those Products confirmed.
It is the responsibility of the Customer to ensure that this acknowledgement correctly reflects its acceptance. The quality, quantity and specification of goods shall be those set out in the order acknowledgement subject to the acceptance that all-natural materials and products supplied are subject to their natural markings, veining’s, variations in colour, cracks, and vents
4. Price & Payment
The price of the Products and our delivery charges will be as stated on your final confirmation.
Product prices include VAT and include delivery for mainland UK, additional delivery charges may be required for more remote areas, we will confirm when we confirm your order. If you do not accept our delivery charges, you original payment will be refunded.
Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an order confirmation.
Payment for all Products must be by credit or debit card. We may accept payment with such cards listed on the site.
Payment terms are:
50% deposit on order
50% balance 10 days before delivery (late payment may affect your proposed delivery date)
5. Cancellations/Modifications to installation date
Cancellation will be charged at the following:
Cancellation less than 7 days after payment of deposit, assuming no made to measure goods have been manufactured, your payment will be returned.
Cancellation thereafter – fully chargeable.
6. Title and Risk
Sculleries of Stockbridge retain ownership of any products ordered and received by the buyer until full payment has been received. The risk transfers once the goods have been delivered to site. Any damage caused on site will be the responsibility of the buyer.
7. Condition of client site
The furniture will be delivered and installed into a finished room, which is air and water-tight, any plastering or building works within the room should be complete before the cabinets are delivered as some furniture will need to be secured to the wall and cannot be moved. It is the responsibility of the client to ensure the site is ready before delivery commences.
8. Governing Law
Any contract made between you and Sculleries of Stockbridge is deemed to have been concluded in Scotland and will be interpreted, construed, and enforced in all respects in accordance with Scots Law.
9. Personal data & Information
At Sculleries of Stockbridge, we are committed to protecting your privacy. We use the information we collect about you to facilitate your product sale. This information will not be released outside our company at any time.
10. Force Majeure
Our performance of any part of a contract with you is subject to variation or cancellation and the grant of an extension of time from any cause arising from an act of God, war, strikes, lock-outs, flood, drought or other cause of any nature whatsoever beyond our control making it difficult or impossible to procure materials, labour or any articles at all and you agree to accept increased prices for the products due to any of the aforesaid reasons, which will always be discussed with you and the best option agreed. In all circumstances time is not of the essence of the contract.
11. Limitation of Liability
The Seller shall not be liable for any indirect, incidental, consequential loss arising out of the Contract or the performance or any use of the Goods or Services. The price shall be affected by any material changes that you request, or which are agreed provided for herein. The maximum liability of the Buyer or the Seller under any Contract between the Buyer and the Seller is limited to the price of the goods.
